After independence, India became a republic with a new constitution finalized on 26 November 1949 and implemented on 26 January 1950. The President is empowered to protect the Constitution of India.

Qualification

        Atleast 35 years of age

        Eligibility for membership of the Lok Sabha

        There should be no remuneration/profit sharing in Government and Government-owned enterprises

Powers and Duties

Legal powers

·        Convening of Parliaments

·        Announcement at the end of the Parliament meeting

·        Power to dissolve the Lok Sabha

·        Power to call a joint session of Parliament to settle differences arising between Lok Sabha and Rajya Sabha on a bill

·        Speech at the first session after the general elections

·        Speech at the first session at the beginning of the year

·        Power to nominate 12 Rajya Sabha members

·        Power to nominate two members of the Anglo-Indian community to the Lok Sabha

·        Bills are officially implemented as law after they are passed in two houses of parliament and assent given by the President.

·        When Parliament is not in session, President can pass emergency laws when necessary.

·        The Chief Audit Officer presents the annual report of bodies like Union Civil Service Commission, Finance Commission etc. in the Parliament.

Powers on Appointment of Ministers

·        Calling the person who has the majority support of the Lok Sabha to form the government

·        Appointing him as Prime Minister

·        Appointment of other Union Ministers on the recommendation of the Prime Minister

Appointment powers

To make appointments to the following posts on the instructions of the Prime Minister.

·        State Governor.

·        High and Supreme Court Judges.

·        Advocate General of the Government of India.

·        Chief Election Commissioners of India.

·        Foreign ambassadors

Financial powers

·        He will set up a Finance Commission every 5 years to distribute funds to the Central and State Governments.

Military powers

·        Commander-in-Chief of the Indian Army, Navy & Air force

Pardoning powers

·        Power to reduce sentence punishment passed by Supreme Court

Emergency Proclamation Powers

·        Proclamation of National Emergency

·        Declaration of State Emergency

·        Declaration of financial emergency

President's rule

In case the law and order and other functions of the state government are not satisfactory, the President will implement the rule in the state by accepting the recommendation of the Governor.

How is the presidential election conducted?

Electoral College

·        People do not directly elect the President

·        Members of Legislative Assembly, Lok Sabha & Rajya Sabha vote to elect the President

·        Nominated Members of Parliament do not have the right to vote

The votes of members of the legislature and parliament are not treated equally as like our votes.

Total Value of Votes of Members of Legislative Assembly / Number of Members of Parliament.

For example

Total vote value of members of Legislative Assembly of Indian states = 5,49,474

Number of Members of Parliament = Lok Sabha (543) + Rajya Sabha (233) = 776

= 5,49, 474 / 776 = 708
